Terms & Conditions
By Proceeding with any Deposition, Hearing, Trial or other Court Reporter Service the following Terms and Conditions are deemed accepted in full.
It is understood that by proceeding with the hearing, law office named in the booking email (referred to as “Customer”) has agreed to pay KW Reporting’s (KW) subsequent invoices timely. Customer further agrees that KW will be compensated at their prevailing rates for all time and related case expenses. Current rates and expenses are set forth per the fee schedule available on request and referred to in the booking email. The rates on the schedule are subject to change on 30 days’ written notice to Customer. Such notice may be via invoice with the changed rates. If Customer declines to pay increased rates, KW will have the right to withdraw from provision of further services on the case.
Customer is responsible for fees for all work carried out. Such work to include all work that has already been requested, even if not completed or performed if not cancelled in line with Cancellation policy set out in booking email as follows:
• Reporter / Realtime / Videographer — 3:00 p.m. business day prior
• Interpreter – 24 business hours prior (some languages 48 bus. hrs.)
• Meeting Room – 48 business hours prior
It is understood and agreed that KW’s compensation has no direct or indirect relationship to any future settlement, compromise, decision or verdict in the pending matter.
It is further understood and agreed that only the instructing law firm and/or attorney is responsible for paying the invoices associated with work carried out or requested by the law firm or attorney. The underlying law firm or client is not a responsible party for these invoices.
All invoices are due and payable “Net 10 Days.” One and one-half percent (1½%) late charge will be assessed after 30 days and on the same day each month thereafter. If it becomes necessary to engage an attorney to assist with collection and/or civil action to collect delinquent moneys (e.g. 90+ days past due), Customer agrees to pay all costs and reasonable attorney fees associated with collection or as deemed reasonable and appropriate by Civil Court if collect action goes to trial. It is agreed that jurisdiction for such civil actions shall be vested in Superior Court, Los Angeles County, California.
Integrated and Entire Agreement
All the representations and promises (if any) previously or contemporaneously made by the parties to this Agreement or any of them, are included herein or else are null and void. No alteration or modification of this Agreement shall have any force or effect unless reduced to writing and signed by said parties. This is the entire Agreement between KW and the Customer.
Severability
If any provision of this Agreement is determined by a court of competent jurisdiction to be illegal or unenforceable, such provision shall be automatically reformed and construed so as to be valid, operative and enforceable, to the maximum extent permitted by law or equity while preserving its original intent. The invalidity of any part of this Agreement shall not render invalid the remainder of this Agreement.
